Security Policy
By using the iStopOver Site (“Site”) and/or the iStopOver Services (collectively the Site and iStopOver services are referred to herein as the “iStopOver Service”), users consent to the collection, use or disclosure of their Personal Information (as hereinafter defined) in accordance with this Privacy Policy. Your continued use of the iStopOver Service following the “last-revised” date on this Privacy Policy will represent your consent to the collection, use or disclosure of your Personal Information under this Privacy Policy as modified. You are advised to review this page regularly for any changes.

We take your privacy very seriously. This Privacy Policy explains how we collect your Personal Information how we protect such data, and the choices you have concerning our use of such data. This Privacy Policy applies only to information collected by us. We are not responsible for the privacy practices of websites that are operated or owned by third parties. If you need to update or revise your Personal Information, become aware of any abuse of your privacy by any person, if you are unhappy with the treatment of your personal information or if you are asked to provide any information that you consider to be inappropriate.
Collection, Storage and Use of User Information
We collect
and store information on our servers as described below that could be
used to identify users individually such as your name, address, email
address, credit card information or other information that is specific
to you (“Personal Information”) for the sole purpose of providing
the iStopOver Service to users.
At
various times you may provide your Personal Information to us. For example,
in order to process a request or enquiry you may make concerning an
accommodation or transaction, we need to know all or some of the following:
your full name, address, telephone number, e-mail address, and, in the
case of a member's (advertising) listing, a method of payment. You may
also contribute Personal Information to us at other times, such as when
registering on the Site. In addition, upon confirmation of your booking
on the Site, you may choose to pay by credit card and in such case,
will provide us with your credit card number. Users
are also required to create a user name and password for login purposes.
After signup, additional users may be added to the service at which
time first name, last name, email address, time zone and user name and
password are required.
Personal data contributed by or collected from users may be stored and processed in the United States or any other country in which we or our affiliates, subsidiaries or agents maintain facilities, and by using our Site, you acknowledge and agree that you may be transferring your personal data outside of the country in which you have contributed it, and that you consent to any such transfer of information outside of your country. These countries may not have similar data protection laws to those that apply in your country. However, if we transfer your personal data outside of your country in this way, we will take steps to ensure that your privacy rights continue to be protected in compliance with applicable data protection law and this Privacy Policy.
iStopOver may also use aggregated Personal Information which cannot identify individual users for editorial and feedback purposes, marketing and promotion, statistical analysis of users behavior, services development, delivering services, providing customer support, customizing and improving the content and layout of the Site, completing business transactions, administering individual accounts and meeting government regulatory requirements such as sales tax collection.
Upon cancellation of an account, all information provided by the user is deleted and destroyed.
Inquiries
Site
users may send inquiries to members via clickable links on Site listings.
If you choose to send an inquiry through these links, your personal
information, including your e-mail address and any other information
you supply, will be visible to the member in question so that they might
reply directly to you. If you call the member, you may be asked to leave
a return telephone number. Do not share information in the e-mail or
phone call that you are not prepared to allow them to have, including,
but not limited to, credit card and bank account information. These
inquiries are both sent to the individual member you selected and retained
by us. The resulting inquiry is available for review only by the member
to whom they were initially addressed and to our customer service employees,
who may be asked by members for their past inquiry information. While
the content of these inquiries is not shared with any other party, the
Site may, from time to time, use third party e-mail servers to send
and track receipt of the inquiry e-mails, and analyze the pattern of
inquiry usage reported by these third party tracking systems; the resulting
information is used and stored only in an anonymised form.
Sharing of Personal Information
iStopOver and
its affliates will not sell, share, license, trade or rent your Personal
Information other than as specified in this Privacy Policy.
iStopOver will not share any information provided by users, except as follows:
Aggregate Information (non-personally identifiable)
iStopOver may use users' Personal Information to generate aggregated information relating to activity on this Site and the iStopOver Service. This aggregate information does not allow the user to be personally identified or contacted and shows user activity as a whole rather than on an individual basis. This information may be shared with relevant iStopOver customers and partners.
When iStopOver Discloses User Information
iStopOver may share users' Personal Information with its affiliates, subsidiaries and service providers for the sole purpose of providing the stayover Service to the user, provided that the information is required for and used only for such purpose and provided the information is used in accordance with this Privacy Policy. For example, where a third party performs services on our behalf and has agreed to keep such information confidential (such as the processing of your credit card payment or the conduct of an online survey for example where a third party performs services on our behalf and has agreed to keep such information confidential. iStopOver will otherwise only release Personal Information to third parties in the following limited circumstances: (i) if a law, regulation, search warrant, subpoena or court order legally requires stayover or its affiliates to do so; (ii) if stayover's rights or property or the rights or property of iStopOver's affiliates, subsidiaries, service providers or the users of this Site or the iStopOver Service are in jeopardy; or (iii) if the personal safety of users of the iStopOver Service or other members of the public is in jeopardy.
Business Transitions
In order to
maintain and operate the iStopOver Service, iStopOver reserves the right
to transfer your Personal Information to its affiliates (the details
of which can be found on the Contact Us page on this Site), or to successors
to the relevant part of any of iStopOver's businesses. In the event
iStopOver or its affiliates goes through a business transition, such
as a merger, being acquired by another company, or selling a portion
of its assets, users’ Personal Information will, in most instances,
be one of the assets transferred. Users will be notified via email
prior to a change of ownership or control of their Personal Information.
If, as a result of the business transition, the users’ Personal Information
will be used in a manner different from that stated at the time of collection,
users will be given a choice to decline such different use.
Please note
that any information included in messages or comments that you have
posted on the Site's community boards, chat rooms or other message areas
or included on a personal profile which you have designated to be "public"
may be viewed by anyone who accesses the Site and cannot be subject
to any expectations of privacy. Information that you provide to the
Site is accessible to any site visitor who knows your username and password.
For this reason, please safeguard your username and password carefully
and do not disclose it to any other person. Users who have not
registered on the Site may not be able to visit all sections of or use
all services offered on the Site.
Communications from the Site
Service Announcements
On rare occasions it is necessary to send out a strictly service related announcement. For instance, if the service is temporarily suspended for maintenance, we may send users an email or SMS message. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.
Customer Service
We communicate with users on a regular basis to provide requested services. In regards to issues relating to their account, we will reply via email or phone, in accordance with the user’s wishes.
Surveys
Occasionally,
the Site requests information from users via surveys. Participation
in these surveys is completely voluntary and the user therefore has
a choice whether or not to disclose information. The requested
information typically includes marketing or product feedback information
and, in some cases, optional contact and / or demographic information.
If provided, contact information may be used for testimonials or to
request additional feedback information. Users will be advised and given
an opportunity to consent or opt-out of such uses. Anonymous survey
information will be used for purposes of monitoring or improving the
use and satisfaction of the iStopOver Service. Users’ Personal
Information is not shared with third parties unless we provide prior
notice and the choice to users. Though we may use an intermediary
to conduct these surveys or contests, the intermediary may not use users’
Personal Information for any secondary purposes.
Protection of
Minors’ Privacy
iStopOver understands
the importance of protecting the privacy of minors, especially in an
online environment. The Site is not intentionally designed for or directed
at individuals under the age of 18 and therefore, it is iStopOvers’
policy to never knowingly collect or maintain information about individuals
who are under the age of 18. If you think that a minor has provided
us with Personal Information, please email us. We will use our
reasonable efforts to delete this information.
Use of Tracking Tools
To enhance
the Internet experience on the Site, iStopOver may use various Internet
technologies such as session 'cookies,' and JavaScript. Session cookies
are placed on your computer in order to identify your web browser and
the activities of your computer on the Site. iStopOver uses these technologies
to customize and enhance the Internet experience of individual users.
You have the option of allowing iStopOver to remember your password
and log-in credentials for your convenience. iStopOver may recognize
you via the session cookies and customize your experience accordingly.
You may disable cookies on your web browser. If cookies are disabled,
however, all features of the Site may not operate as intended. Information
about the procedure you are required to follow in order to disable cookies
can be found on your Web browser’s help feature.
You may encounter
'cookies' or other similar devices on certain pages of the Site that
are placed there by third parties. For example, if you view a webpage
created by a user, there may be a cookie placed within that webpage.
We do not control the use of cookies by third parties.
Links to Other Web Sites
The Site may
contain links to other Internet Sites. iStopOver does not endorse, and
is not responsible for, the privacy practices or the content of these
Sites. You should review the applicable privacy policies in connection
with your use of such third party Sites.
Like most standard
Web and mobile internet sites, iStopOver stores and uses web server
log files. These files include anonymous information about web
browsers, such as internet protocol (IP) addresses, browser type, internet
service provider (ISP), referring/exit pages, platform type, date/time
stamp, and number of clicks to analyze trends, administer the site,
track users’ movement in the aggregate, and gather broad demographic
information for aggregate use. Such log files are not linked to
Personal Information through the iStopOver Service.
Security Measures
iStopOver has
established reasonable precautions to protect collected Personal Data
from loss, misuse, unauthorized access, disclosure, alteration or destruction,
which include contractual, administrative, physical, and technical steps.
Technical measures include use of firewall protection and encryption
technology where appropriate. Although iStopOver takes reasonable precautions
to assess the reliability of such technology, it relies on the statements
of the vendors of those products and services as part of its security
evaluation. Please note that while iStopOver has endeavored to create
a secure and reliable site for users, the confidentiality of any communication
or material transmitted to/from iStopOver or the Site cannot be guaranteed.
Notwithstanding the foregoing, it is each user’s responsibility to:
(i) protect
against unauthorized access to your use of the Site; (ii) ensure no-one
else uses the Site while the user's machine is "logged on"
to the Site service; (iii) log off or exit from Site when not using
it; and where relevant, (iv) to keep his/her password or other access
information secret. All personal information is stored on a secure
server. We do not store credit card numbers or related identifying information
on any Site server. All such information is stored by our credit card
processing partner, on their secured servers, and is protected via its
proprietary methods.
Export of Personal Data
By using the
Site, you acknowledge and consent to the fact that Personal Information
provided by you or collected by us through your use of the Site is stored
and processed by us in the United States where data protection laws
may not afford the same level of protection as those of the country
in which you are located (particularly for users located in the European
Economic Area (EEA)). You also acknowledge and consent to the fact that
we may, at our discretion, store and process such data in other countries
(including countries outside the EEA) where data protection laws may
not afford the same level of protection as those of the country in which
you are located.
International Users - Applicable
Law
We collect,
process, store, disclose and dispose of Personal Information that you
submit to us in accordance with applicable United States law. Please
note that the Personal Information you submit to our Service will be
transferred to the United States to be processed by us in order to provide
the Site and its services to you or for such other purposes as set forth
in this Privacy Policy. If you are not a resident of the United States,
you acknowledge and agree that we may collect and use your Personal
Information, as discussed in this Privacy Policy, outside your resident
jurisdiction. In addition, we may store such Personal Information in
the United States, outside your resident jurisdiction. In particular,
you are advised that the United States uses a sectoral model of privacy
protection that relies on a mix of legislation, governmental regulation
and self-regulation. Please be aware that United States law may offer
different levels of protection for Personal Information than may be
available in your country.
Changes to our Privacy Policy
We may from time to time review and revise our privacy practices and will post any changes to this Privacy Policy here. Please refer back to this Privacy Policy on a regular basis. Your continued use of the Site following changes posted to this Privacy Policy will mean that you accept those changes.
Correcting/Updating/Deleting/Deactivating
Personal Information
If a user’s Personal Information
changes (such as phone or email address), the user may update this information
on the Site. If a user no longer desires to use the iStopOver Service,
iStopOver provides a way to delete/deactivate users’ Personal Information.
Account deletion/deactivation can be done online.
